Please read these terms and conditions of use ("terms of use") carefully before using this website. By using this website, you agree to be bound by these terms and conditions, and privacy policy (incorporated by reference). If you do not agree to these terms and conditions, do not use this site.


These Terms of Use apply exclusively to your access to, and use of, the Sarara Foundation website www.sarara.co, to all associated subdomains, online services, and mobile applications, and to those sites listed in the paragraph below labelled “Additional Websites Subject to Terms of Use” (collectively, the "Site").

If you are using the Site on behalf of any entity, you represent and warrant that you are authorized to accept these Terms of Use on such entity's behalf, and that such entity agrees to indemnify you and Sarara for violations of these Terms of Use.

Change to these terms

Sarara reserves the right to modify these Terms of Use at any time and may, in its sole discretion but shall not be required to, publish notifications of material modifications in. Any and all changes or modifications to these Terms of Use will be effective immediately upon posting of the revisions on the Site. Your continued use of the Site following the posting of changes or modifications will constitute your acceptance of such changes or modifications. If you do not agree to the amended terms, you must stop using the Site.

This Website (or the “Site”) is operated by The Sarara Foundation, a 501(c)(3) tax exempt organization duly organized in the United States (EIN 82-2386824) and our registered office is 1031 33rd Street, Denver, CO 80205. This website is operated on behalf of us, as well as the Namunyak Wildlife Conservation Trust and Namunyak Projects, Ltd.

Sarara controls and operates this Site from the United States. Sarara makes no representation that materials in this Site are appropriate or available for use in other locations, and access to this Site from territories where its contents are illegal is prohibited. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws.

The content of the Site is offered for general information, discussion, and entertainment purposes only.

The material and Content displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Site, or by anyone who may be informed of any of its contents.

Accessing the Site

You may access the Content on the Site only for your own personal, non-commercial use. Where the Site contains links to other websites and resources provided by third parties, these links are provided for your information only. We make no representations about any other websites. When you access any other website through the Site (including the websites of any of our conservation, commercial and charity partners) you understand that it is independent from us and that we have no control over such website and can accept no responsibility in relation to its content or the way you interact with it.

Indemnity

You agree to fully indemnify, defend, and hold harmless Sarara, its affiliates or their licensors, service providers, employees, agents, officers, and directors, from any claims, losses, or damages, including legal fees, resulting from your violation of these Terms of Use, your use of the Site, or your placement of any content onto the Site, and to fully cooperate in Sarara’s defense against any such claims.

Severability/Waiver

No waiver of by us of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and our failure to assert a right or provision under these Terms of USE shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms of Use will continue in full force and effect.

Choice of Law and Jurisdiction

You agree that any dispute arising out of or relating to the Site, these Terms of Use, or any materials or Content posted to the Site, including copies and republication thereof, whether based in contract, tort, statutory, or other law, will be governed by the laws of the State of Colorado, excluding its conflicts of law provisions. You further consent to the personal jurisdiction of and exclusive venue of Denver County, Colorado as the legal forum for any such dispute.

Integration

These Terms of Use constitute the entire agreement between you and Sarara with respect to the subject matter herein and supersedes any and all prior or contemporaneous oral or written agreements.
